GermanZero Hamburg<p>In seiner Urteilsbegründung zum Gesetzesentwurf von <a href="https://climatejustice.global/tags/BerlinAutofrei" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>BerlinAutofrei</span></a> räumt der Berliner Verfassungsgerichtshof mit den oft bemühten Phrasen "Freiheit statt Zwang" und "Anreize statt Verbote" der Gegner:innen von <a href="https://climatejustice.global/tags/PushMa%C3%9Fnahmen" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>PushMaßnahmen</span></a> für die <a href="https://climatejustice.global/tags/Verkehrswende" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>Verkehrswende</span></a>, <a href="https://climatejustice.global/tags/Klimaschutz" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>Klimaschutz</span></a> und <a href="https://climatejustice.global/tags/VisionZero" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>VisionZero</span></a> auf:</p><p>Der vorgesehene Regelungen sei angemessen, da sie "mehrere überragend wichtige Gemeinwohlbelange" verfolge ("Leben und Gesundheit aller Verkehrsteilnehmenden", "Ziele des Klima-, Natur- und Umweltschutzes"). Das "Gewicht der sie rechtfertigenden Gründe" wahre "die Grenze der Zumutbarkeit" (S. 45). </p><p>Die angestrebten Maßnahmen seien "zur Zielerreichung erforderlich". Zwar seien "verschiedene regulative Maßnahmen vorstellbar, um die Zahl der verkehrsbedingten Todesfälle und Verletzungen zu senken, gesundheits-, klima- und umweltschädliche Emissionen, insbesondere Lärm und Abgase zu verringern, das Sicherheitsgefühl und Wohlempfinden gerade auch von besonders schutzbedürftigen Verkehrsteilnehmenden zu verbessern, die Wohn- und Aufenthaltsqualität zu steigern sowie die geschäftliche und kulturelle Attraktivität Berlins zu fördern", aber "keine dieser Maßnahmen erscheint gleich wirksam."
